1. Introduction

Welcome to Kurncy Wallet ("Kurncy", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Kurncy Wallet and API services (collectively the "Services") provided by Kurncy Solutions Inc., a company incorporated under the laws of Canada.
By accessing or using our Services, you agree to comply with these Terms and any applicable laws or regulations. If you do not agree, please do not use our Services.

2. Eligibility

You must be at least 18 years old and reside in a jurisdiction where access to our Services is not prohibited by applicable law. By using the Services, you represent and warrant that:

  • You are not a person or entity subject to sanctions or restrictions in Canada, the U.S., or other relevant jurisdictions.
  • You are acting on your own behalf or with legal authorization from a business entity.

3. Nature of Services

Kurncy Wallet is a non-custodial wallet. We cannot decrypt your private keys or recovery phrases. This means:

  • You alone are responsible for securing your wallet credentials (seed phrase, password, etc.).
  • If you lose access, we cannot recover your funds.

Our Services include:

  • Storage and transfer of KAS and KRC-20 tokens, KRC-721 NFTs and KNS domains
  • Fiat-to-crypto and crypto-to-fiat conversion tools
  • APIs for third-party integrations
  • Real-time price and transaction monitoring tools

4. Compliance & Regulation

We are committed to complying with:

  • FINTRAC (Financial Transactions and Reports Analysis Centre of Canada)
  • AMF (Autorité des marchés financiers – Québec)
  • Anti-Money Laundering (AML) and Know-Your-Customer (KYC) obligations where applicable

Our partners and API integrators may require identity verification. You agree to submit accurate documents when requested.

5. User Responsibilities

You agree not to:

  • Use the Services for any unlawful, illegal, or fraudulent purposes
  • Distribute viruses, malicious software, or engage in attacks on the network
  • Attempt to reverse engineer or tamper with the Services or our intellectual property

You agree to maintain accurate information on your account and immediately notify us of any unauthorized use.

6. Fees

Kurncy may apply network fees (gas), conversion fees, and platform usage fees (Kurncy fee) which will be disclosed transparently before processing. Partners may set additional fees as per their agreements.

7. Risk Disclosure

  • Cryptocurrency markets are volatile. You may lose part or all of your investment.
  • Kurncy does not guarantee token price stability, performance, or future value.
  • You acknowledge that you use the Services at your own risk.

8. No Custodianship or Financial Advice

Kurncy is a technology platform, not a financial institution or broker. We do not:

  • Hold user funds
  • Provide investment advice
  • Guarantee financial returns

You should consult with financial and legal professionals before making investment decisions.

9. Intellectual Property

All content on the Kurncy platform—software, logos, white paper materials, and branding—is the property of Kurncy Solutions Inc. or its licensors. You may not:

  • Copy, reproduce, distribute, or create derivative works without our express written consent.

10. Privacy

Your privacy is important to us. Please refer to our Privacy Policy to understand how we handle your personal information. We do not track or store wallet private keys, transactions, or balances unless expressly required for compliance with legal obligations.

11. Third-Party Services

Some Services are delivered via third-party partners (e.g., fiat on-ramps). Kurncy is not responsible for their actions, fees, or terms. You agree to review and comply with any third-party terms as applicable.

12. Modifications

Kurncy may update these Terms at any time. We will notify you of significant changes via our website or app. Continued use of the Services after changes implies acceptance of the updated Terms.

13. Suspension or Termination

We reserve the right to suspend or terminate access to the Services if you breach these Terms, violate laws, or engage in suspicious activity. Kurncy also reserves the right to discontinue the Services for operational or legal reasons.

14. Limitation of Liability

To the fullest extent permitted by law:

  • Kurncy shall not be liable for any loss of funds, profits, data, or business opportunities resulting from use or inability to use the Services.
  • We provide the Services "as is" and "as available" with no warranties.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Québec and the laws of Canada. You agree that any dispute arising from these Terms will be resolved exclusively in the courts of Québec, Canada.

18. KaspaCom Marketplace Terms

If you access the KaspaCom Marketplace through Kurncy Wallet, you agree to the KaspaCom Terms of Trade. Please review the latest terms at kaspa.com/terms-trade. If there is a conflict between KaspaCom's marketplace terms and these Terms, KaspaCom's terms govern marketplace transactions, while these Terms govern your use of the Kurncy Wallet.
